Il Codacons avverte i consumatori e le scuole che possono cancellare le prenotazioni di viaggi all`estero senza alcuna penale, nonostante le proteste delle agenzie di viaggio. Ciò è possibile per il solo fatto dello scoppio della guerra in Iraq che coinvolge in pieno sia l`Italia che gran parte dell`Europa (Spagna e Inghilterra). Grazie alla circolare del Ministero della pubblica istruzione di ieri , che ha sconsigliato tali viaggi si è predeterminata la prova documentale della causa di forza maggiore che consente in base al codice civile di disdettare un contratto senza alcuna penale da pagare.
Lo stesso principio vale anche per tutti i turisti che intendano cancellare prenotazioni per pacchetti o voli e in qualsiasi parte del mondo, anche per paesi non direttamente interessati dalla guerra, visto che l`area interessata copre praticamente tutto il pianeta e non è possibile spostarsi senza invadere le rotte aeree percorse da mezzi militari come i B52 inglesi che hanno percorso praticamente mezzo globo per arrivare sull`Iraq.
E` sufficiente inviare una raccomandata con ricevuta di ritorno al tour operator facendo riferimento alla situazione venutasi a creare e richiedere indietro gli acconti versati. In caso di rifiuto le sedi del Codacons sono a disposizione degli utenti per agire dinanzi al giudice di pace.
Il CODACONS ha poi chiesto al Ministero dell`Istruzione di vietare in assoluto i viaggi all`estero fino al termine del conflitto, essendo ben possibile svolgere visite culturali per le scolaresche in Italia senza rischi o con minori rischi.
