Ciò che è avvenuto oggi all’Eurostar Roma-Perugia, fermo da quasi 4 ore in galleria, e la fotocopia di quanto avvenuto pochi anni fa ad un treno, i cui passeggeri sono rimasti per ore bloccati in galleria a bordo del convoglio al freddo e al buio.
Proprio da quella vicenda ? fa sapere il Codacons ? è nato un precedente giudiziario molto importante: il Giudice di pace di Roma Bruno Bientinesi ha infatti emesso tre sentenze a favore di alcuni passeggeri di quel treno, liquidando loro un risarcimento di un milione e mezzo di lire ciascuno.
Il giudice motivava la decisione con “il grave turbamento fisio-psichico imputabile alle FS in quanto per imperizia e negligenza dei propri servizi tecnici ha provocato il prolungarsi di uno stato di sofferenza ben oltre il limite del ragionevole e del sopportabile …“
Il Giudice sosteneva inoltre che “quattro ore per portare fuori dal tunnel l`ETR rappresentano un tempo enorme che ha fatto sfiorare ben più tragiche conseguenze; un tempo che può essere spiegato solo con un notevole grado di disorganizzazione ed impreparazione dell`apparato tecnico delle FF.SS. e lascia presumere la mancanza di piani operativi per fronteggiare situazioni di emergenza come quella per cui è causa“.
Ebbene, secondo il Codacons le analogie tra i due episodi sono evidenti. Per questo l’associazione invita i passeggeri dell’Eurostar Roma-Perugia fermatosi in galleria a rivolgersi ai legali Codacons per intentare analoga causa di risarcimento dinanzi al Giudice di pace.
