ROMA – Lotta a tutto campo contro i cartelli e nessuna marcia indietro sulle liberalizzazioni. Ma anche i broker per le assicurazioni ed una continua vigilanza sul comparto dei carburanti. Sono i messaggi che arrivano dalla relazione annuale dell’Antitrust, presentata al Parlamento dal presidente Antonio Catricalà . Nessuno sconto sulle intese che restringono la concorrenza, quindi, perchè “i cartelli non sono peccati veniali ma gravi misfatti contro la società che corrompono la libera competizione sul mercatoâ€. E diventano “particolarmente odiosi†quando colpiscono beni di prima necessità , come il pane. Non a caso negli Usa sono considerati “crimini e puniti con la prigioneâ€.
Per questo Catricalà chiede per l’Antitrust armi più affilate di quelle a disposizione, con la possibilità , ad esempio, di poter “sanzionare le singole imprese quando l`intesa collusiva è frutto di una delibera dell’associazione di cui fanno parte, un soggetto spesso inconsistente dal punto di vista economico e patrimonialeâ€. Occorre anche “migliorare la disciplina dei programmi di clemenza a favore di chi collabora†denunciando un cartello di cui ha fatto parte, ad esempio riducendone la responsabilità civile.
Arriva anche un monito sulle liberalizzazioni: rinunciarvi “sarebbe un errore imperdonabileâ€, sottolinea Catricalà . “Soprattutto per l’Italia, che non gode di materie prime e di autonome risorse, una politica di chiusura sarebbe disastrosaâ€, spiega il Garante, che esprime “un primo giudizio di segno positivo†per le misure varate dal Governo e si augura “una veloce definitiva approvazioneâ€.
Parole che hanno trovato l’appoggio delle associazioni dei consumatori: se l’intervento di Catricalà è “condivisibile†per Adusbef e Federconsumatori, Cittadinanzattiva lo trova “magistraleâ€, mentre per il Codacons si tratta di “una voce che urla nel deserto e chiede aiuto, ma che nessuno ascoltaâ€.
Ecco alcuni degli argomenti principali della relazione dell’Antitrust al Parlamento.
Banche: abolire la commissione di massimo scoperto, sciogliere anche gli intrecci di ruolo che riguardano le società quotate: il 45% di queste ha fra i propri soci imprese concorrenti mentre l’80% vede nei propri board persone presenti contemporaneamente negli organi di gestione dei competitor.
Class action: il rinvio al primo gennaio 2009 “rischia di disattendere le speranze di migliaia di persone che chiedono tutela in tempi breviâ€, ma questi sei mesi devono essere usati per migliorare il provvedimento e ad estenderlo anche alla P.A.
Assicurazioni: “Potrebbe essere applicato un sistema di brokeraggio analogo a quello anglosassoneâ€, perchè è particolarmente “importante scindere il legame ferreo tra società prodotto e canali distributiviâ€. In questo modo, “i broker sceglierebbero per i clienti le migliori offerte e le commissioni sarebbero ben evidenziateâ€. – Carburanti: l’Antitrust vigilerà “con rigore†per i prossimi 5 anni sull`attuazione degli impegni presi dai petrolieri per l’apertura della rete di distribuzione, “data la rilevanza strategica del settore per l’intera economiaâ€.
Sanzioni: nell’ultimo anno ne sono arrivate per 86 milioni di euro, di cui 62 milioni per i cartelli. E la rivista Global Competition Review ha collocato l’Antitrust italiana al primo posto nella lotta ai cartelli tra tutte le autorità dell’Ue.
