L`ex dg della Juventus Luciano Moggi e L`ex ad della Juventus Antonio Giraudo hanno presentato al Tar del Lazio i loro ricorsi contro la sentenza di secondo grado della Corte Federale.
Il codacons scende in campo per contrastare i ricorsi di Moggi e Giraudo e presentando ricorso incidentale chiede l`annullamento della decisione della corte d`appello federale troppo buonista!!
Scopo dell’associazione è quello di ottenere la conferma della sentenza di primo grado inflitta a tutti gli imputati dello scandalo di calciopoli.
Secondo l`avv. Carlo Rienzi, presidente del Codacons che agisce insieme all`associazione utenti sportivi, vi sarebbe un ?Difetto di costituzione? nella commissione della corte d’appello federale che ha ridotto tutte le pene in quanto alcuni membri della stessa commissione erano legati da rapporti professionali con imprenditori avvantaggiati in quanto sponsor delle squadre dalle semiassoluzioni.
Dinanzi al Tar del Lazio il Codacons chiederà inoltre che vengano dichiarati inammissibili i due ricorsi presentati dai ?rappresentanti della cupola? e chiederà per ognuna delle parti coinvolte nel processo un risarcimento danni pari a 2.000.000 di euro che l’associazione devolverà all’ Associazione per le vittime del doping.
Nel ricorso che sarà deciso martedì prossimo dalla terza sezione del TAR presieduta da Francesco Corsaro, si sostiene che :
“La decisione di secondo grado ha inspiegabilmente attenuato responsabilità che apparivano gravi univoche e concordanti dei ricorrenti in questa sede offendendo la natura e la funzione dello sport e convalidando comportamenti che sono e restano gravissimi nella misura in cui hanno offeso la credibilità del calcio e indotto i tifosi ad assistere a spettacoli taroccati per opera di dirigenti ed arbitri compiacenti“.
Di qui il ricorso incidentale che chiede l`annullamento della sentenza di appello e il ripristino di quella della CAF di primo grado più severa.
