I trapianti di organi in Italia vanno a rilento non tanto per la mancanza di donatori quanto per le carenze organizzative del sistema sanitario che non ha ancora attuato i dispositivi di legge.
Negli altri paesi il consenso deve essere espresso nei seguenti modi:
DANIMARCA (L. 13/6/1990 N.402) |
Il prelievo è consentito nel caso in cui il deceduto abbia espresso in vita, per iscritto o oralmente, tale volontà, ovvero non abbia mai indicato la sua obiezione ed i parenti più stretti abbiano dato il loro consenso |
AUSTRIA (L. 1/6/1982) |
Il prelievo è vietato se il medico è in possesso di una dichiarazione nella quale la persona morta o il suo legale rappresentante ha espressamente rifiutato la donazione. |
GERMANIA (Atto di indirizzo del Parlamento) |
Vige l`obbligatorietà del consenso esplicito, espresso in vita dal donatore, oppure testimoniato dai parenti. |
FRANCIA (L. 29/7/1994 n. 94-654) |
Il prelievo può essere effettuato, dopo l`accertamento della morte, qualora la persona interessata non abbia fatto conoscere, mentre era in vita, la sua obiezione |
SVEZIA (L. 14/5/1987 n. 270) |
Il prelievo può essere effettuato su una persona deceduta che abbia dato in vita il suo consenso scritto;comunque, in assenza di tale consenso, si può procedere al prelievo se il deceduto ha espresso in qualsiasi modo il suo consenso e se si può supporre che esso non sarebbe stato in contrasto con le sue opinioni. Se c`è un dubbio sui desideri del deceduto, il consenso può essere espresso da uno stretto parente. Se i parenti non sono d`accordo, l`intervento non si può effettuare. |
SPAGNA (L. 27/10/1979 n. 30) |
Si può procedere al prelievo di organi se la persona deceduta non ha registrato un`opposizione scritta alla donazione. |
NORVEGIA (L. 9/2/1973 n. 6) |
Si può procedere al prelievo se la persona deceduta ha lasciato istruzioni scritte o orali in tal senso; se il decesso avviene in ospedale si può procedere al prelievo, in mancanza di testimonianza, a meno che il deceduto o i parenti stretti non abbiano espresso obiezioni, ovvero vi siano motivi di credere che il prelievo sarebbe in contrasto con le sue opinioni e quelle dei suoi familiari. |
GRAN BRETAGNA (L. 26/6/1986) |
Il prelievo è consentito quando il deceduto in vita abbia consentito per iscritto o oralmente dinanzi a due testimoni, ovvero non si abbia ragione di credere che in vita abbia espresso un`obiezione, ovvero il coniuge o parenti non siano contrari. |
STATI UNITI (Uniform Anatomical Gift 1987) |
Una donazione di organi o tessuti può essere fatta solo con il consenso scritto e firmato dal donatore; tale donazione non richiede opinioni di altre persone dopo la morte. |
BELGIO (L. 13/6/1986) |
Si procede al prelievo a meno che in vita non sia stata espressa un`obiezione; l`obiezione può essere espressa da un parente di I grado o dal coniuge ma non può prevaricare la volontà espressa dal defunto |
GIAPPONE | Il consenso deve essere dato per iscritto dal donatore e dai suoi familiari. |
