Questa la lettera che il Codacons ha inviato oggi al Presidente della Repubblica Ciampi e al Ministro della Salute Girolamo Sirchia, relativamente alla nuova legge sul fumo approvata al Senato che, per l’associazione, è carente sul piano della tutela della salute dei lavoratori, in quanto non prevede il divieto nei luoghi di lavoro privati e non aperti al pubblico.
?Scriviamo questa lettera per esprimere tutto il nostro sostegno e supporto per la nuova legge contro il fumo in discussione in questi giorni, ma anche per esprimere tutta la nostra preoccupazione per quello che riguarda la tutela prevista da tale legge per i luoghi di lavoro privati.Il comma 1 prevede infatti:
1. E` vietato fumare nei locali chiusi, ad eccezione di:
La nuova legge, pertanto, NON VIETA IL FUMO NEI LUOGHI DI LAVORO PRIVATI NON APERTI AGLI UTENTI O AL PUBBLICO. E, purtroppo, anche il comma 2 prevede gli impianti di aerazione ESCLUSIVAMENTE nei locali CONTRASSEGNATI PER FUMATORI (escludendo ESPLICITAMENTE il comma 1 lettera a):
2. Gli esercizi e i luoghi di lavoro di cui al comma 1, lettera b), devono essere dotati di impianti…
E dunque, in concreto, sui luoghi di lavoro privati (che rappresentano il 90% dei luoghi di lavoro, proprio dove e` più sentito il problema del fumo passivo) con la nuova legge sara` possibile fumare LIBERAMENTE, senza neanche gli aeratori! Purtroppo gia` oggi la normativa che vieta il fumo non si applica DIRETTAMENTE ai luoghi di lavoro privati, per i quali vi e` pero` tutta una costruzione giurisprudenziale (che si basa sugli artt. 32 e 41 della Costituzione e su varie leggi speciali, tra cui in particolare il DL 626/94) per cui sussiste comunque l`obbligo del datore di lavoro di tutelare la salute dei propri dipendenti. In questi casi, non sussistendo però un divieto esplicito, e` purtroppo necessario per il lavoratore rivolgersi all`autorità giudiziaria, sia per l`eventuale risarcimento dei danni ma anche, in via preventiva, per un`azione cautelare che proibisca il fumo sul posto di lavoro. E questa costruzione, nonostante l`evidente GRAVOSITA` ANCHE ECONOMICA per il lavoratore che vuole tutelare il proprio diritto alla salute, e` stata sino ad oggi “l`ancora di salvezza“ fatta propria dalla giurisprudenza che, in concreto, e` riuscita a VIETARE IL FUMO nei posti di lavoro privati. Ma tale nuova legge in approvazione, quando statutisce che “e` vietato fumare nei locali chiusi, ad eccezione di quelli privati non aperti ad utenti o al pubblico“, ADDIRITTURA potrebbe IMPEDIRE ai giudici la possibilità di VIETARE IL FUMO nei luoghi di lavoro privati!! E questo proprio in questi giorni quando l`Oms chiarisce (se mai ce ne fosse stato bisogno) che il fumo passivo sul posto di lavoro porta a un RISCHIO DI CANCRO del 16-19 per cento! E quando le ultime ricerche dimostrano che in una stanza dove si fuma il livello di polveri sottili raggiunge quantità 5 VOLTE SUPERIORI al livello necessario per fermare il traffico nelle città…Il Codacons, pertanto, rinnovando tutto il nostro sostegno e la nostra disponibilità per l’opera di lotta contro il fumo, chiede che tale legge in approvazione VENGA MODIFICATA, prevedendo, esplicitamente, IL DIVIETO DI FUMO in TUTTI I LUOGHI DI LAVORO, PUBBLICI E PRIVATI.
