Prosegue la battaglia del Codacons contro le spese di spedizione delle bollette da parte di Telecom Italia. L’associazione, infatti, ha deciso di costituirsi dinanzi al Tar Lazio, al fianco dell’Autorità per le comunicazioni, a tutela della delibera n. 129/07/CIR e degli interessi di milioni di utenti costretti all’odioso balzello.
L’Agcom, infatti, con tale delibera sostiene che Telecom Italia debba rimborsare gli importi fatturati indebitamente a titolo di spese di spedizione; contro la tale delibera la società telefonica ha proposto ricorso al Tar Lazio.
Il pagamento delle spese di spedizione è illegittimo – spiega il Codacons – quando non è prevista in favore degli utenti la possibilità di ritirare le fatture direttamente presso le sedi della società, e quando non è previsto l’invio delle bollette in formato elettronico attraverso il web.
L’illegittimità della richiesta di tale balzello deriva dal fatto che Telecom Italia, a differenza di altri enti o società, non ha recepito la riforma legislativa che consente l’emissione della fattura in via elettronica attraverso il web. Così, mentre altre aziende o enti mettono le fatture a disposizione degli utenti anche attraverso internet, e ognuno da casa può comodamente leggere e stampare le proprie bollette, Telecom si ostina a spedirle in forma cartacea e via posta, guadagnando anche sulle spese di spedizione postali.
Finchè Telecom non adotterà in favore di tutti i propri utenti sistemi di emissione delle fatture alternativi al cartaceo, qualsiasi costo richiesto deve essere considerato indebito e va quindi restituito agli utenti.
A tal fine l’associazione sta studiando una class action in favore dei clienti Telecom, per far riavere loro i 25 milioni di euro che ogni anno la società incassa grazie al balzello delle spese di spedizione.
